I understand your feelings and of the person who is going through this. But to all calm down and think. The parents have made a mistake.(My friend has such kind of nanny too who is here on a visitor visa but she is not like this and I do not blame these parents too for hiring one like this)
Some say they should go to the cops, use (U Visa) etc ..but when you go to the cops they will take her in and ask her information (SSN and stuff) and when they find that she is not legally eligible to work then what will the parents have to go through now.
The Social Services is different from immigration (True) but Social Services will take away the baby from the parents because they have committed a federal offence and they are not capable of taking care of the baby.
This is what happened with my cousin. My niece fell down from the stairs and was hurt real bad. When my cousin took her to the hospital the hospital authorities called social services saying that they are not taking care of the baby and are harming the child. The family doctor who was paged saved them by giving his gaurantee.
First it is a federal offence and irresposibility will cause them a price.
(To the parents: Sorry sir I do not mean to say that you are irresponsible but
this is what they might say)
Please take extra precaution when you are dealing with a minor.

The passport has Given name as XYZ ABC ....and surname is blank
The EAD ,485 ,Social Security Card has

I would suggest two things:
1) Fire her and let her know the reason. If possible show her the video, that will definitely scare and embarrass her. You cannot undo what she did to your child but that will teach her a lesson and hopefully prevent her from doing that to another child.
2) I would highly recommend sending your child to a reputed daycare. Ofcourse your child will not get personal attention like home, but that ensures the safety of the child. There are other benefits of a daycare like - social interactions, personality development, fixed routines, curriculums, and above all they are trained professionals.
Give it a thought.

We had hired an Indian nanny in NJ who, we learnt after hiring her, is here on a tourist visa. We were paying her $350 per week cash, which is the standard rate around here for nannies (incl. citizens and people on GC). We had liked her when we met her in response to an ad on Sulekha, and we thought an Indian nanny would be good for our first child. She has been with us for about 3 months, and we were intermittently not getting a good feeling with her for some reason. We finally bought a small security camera and installed it yesterday. On the very first day with the camera, we came home and saw the recorded video to find that she is violently hitting the baby on two separate occasions. Needless to say, it has shocked, angered and extremely saddened us. I showed the video to a couple of friends and even they say it is unbearable to watch. This was just the first day of recording and it pains us tremendously to think what all may have happened previously.
She is of course not going to stay with the baby alone anymore, but I want to know what legal options I have to penalize her to the fullest extent, so that she does not do this to anybody else�s small babies. She it seems had come here last year and taken care of someone else�s baby in Hoboken, and I can imagine that their baby also went through this. (This woman and her husband are a ~ 35 year old couple, who have a multiple entry ten year tourist visa; both come here for 6 months every year and work odd jobs like this. They apparently got a (unsponsored) tourist visa after showing a lot of landed property in India).
I specifically want to know if I will have potential problems if I go to law enforcement about this- regarding have employed her (both of us are on H1B visas). Your posts are getting very irritating with this blind belief in this "Unitednations" fellow. Why do you believe in him so much? What has he done?
People in this forum are about 1.5 years behind in the understanding of retrogression (all of these issues have been dissected, diseminated, corroborated, etc.); how the law works; what visa bulletin said in November 2005. dissecting numbers, etc.
There is much deeper understanding of this on immigration.com since it has been going on for a while. Chandu is a member there and has been following it and participating on it.
I would think something as important as this; one would research it to death and get all possible statistics on it. All these things have already been laid out in great detail very long ago.

I grow different kind in my backyard. It all depends on the size of your backyard and which zone you live in states. I live in virginia. By this August end /september first week summer crop will end. I grow tomatoes(30 plants), Mint, snake guard, water melons (15 plants), cantaloupes(10 plants), carrots, okra, spinach , chillis. Its fun and hard work too. You need to dig the soil, mix with top soil or garden soil and cultivate it. Every week fertilize it. This is my first year gardening. I have around 3000 square ft of back yard. i do not know what to do with that. I cannot maintain Lawn in back yard. So I decided to grow vegetables.
I am eagerly waiting for my fall garden..I am planning to grow tulips,beets,cilantro,carrots,potato,peas etc., If I can get same space for garden In India and work place just 3 miles from home , I can happily go back to India.

She had her delivery in a hospital which automatically assures adequate care for the child (paid for by the good citizens of Maricopa county, i should add).
As long as the pregnancy is uncomplicated, a woman is perfectly capable of delivering with a leg shackled. In no way does that put her at risk of complications.

2. Why do we sit down and accept what is given to us instead of asking for what we want/ desire?
3. Why do I hear - "I am not interested in protesting" or "I don't have the time" from folks that are paying a high price due to retrogression?
We are LEGAL, tax paying, resident aliens that are contributing to the economic growth and not siphoning off government funds. Don't we deserve better?

What I and the majority of people in this forum do is their best to make sure they dont loose their status. If on the other hand it happens I would return to India and consider all options to reverse it. What I and majority of people here wouldnt do is stay here illegally.
Even if it happens I would ask for food as a favor from some one rather than break into their house and demand it as a right!
I dont hate them, i just think what they do is wrong and they shouldn't be rewarded for it. If an illegal comes asking for food, I am pretty sure every one will be happy to feed him. But if breaks into my house and starts raiding my refrigrator, he better watch out.

Looking everything via a legal/illegal magnifying glass can get you only so far. Basic respect for human life is extremely important without which there will be no difference between us and barbarians.

It is documented where the Sheriff has made statements to the affect of calling these folks animals, disease carrying, who smell and dress up like animals etc. Shackling a pregnant woman when she is delivering is another example of the same attitude. You condoning that fact by statements like "woman is perfectly capable of delivering with a leg shackled" is just pathetic. It is not always about your 'legality/illegality' or your brilliant career or fantastic green card. Just pathetic.

I have canceled 8/24 appointment and plan on taking appointment during first week of September. Los Angeles USCIS have plenty slot available, so taking it easy in taking appointment.

My wife got her name changed on the passport last week from the DC embassy. Her original Indian passport had only her first name and her last name was blank. Her US documents (Visa, SSN, Drivers License, etc) had her name as <first_name> FNU (Family Name Unknown). For a passport name change, the Indian Embassy requires you to:
1. Create an Affidivate in India saying that the name needs to be changed from <first_name> <blank> to <first_name> <last_name>.
2. Publish the name change in a national newspaper.
3. Publish the name change in a local US newspaper.
Along with the name change application, you have to submit the original affidivate, the paper clipings of the Indian newspaper and the local US newspaper.
Alternatively, if you have a marriage certificate and the marriage certificate lists your name as <first_name> <last_name> rather than <first_name> <blank> (as on your passport), you do not need the affidivate and a copy of the marriage certificate is sufficient.
The renew/change-passport-by-mail service that the indian embassy provides will take 10-12 business days (excluding Indian public holidays :) ). If you go in person to the consulate/embassy you can get your passport back within 3-5 days.
Atleast as far as I know, the DC embassy doesn't have any same-day service(don't take my word for that, I could be wrong). Good luck !

#21 May 2007 - File for 7th year H1B extension
#22 Jun 2007 - EB3 I-140 filed (Still pending). Obtained receipt
#23 Jul 2007 - H1B Extension approved (new I-94 with expiration of Jun 2008)
#24 Jul 2007 - Ready to file I-485 concurrent with EB3 I-140
From february 2004 (expiry date of i-94 card) until april 1994 it looks like you accrued unlawful presence. The unlawful presence stopped when you filed the 485.
The unlawful presence was wiped out when you left and re-entered usa (the 3 year bar didn't kick in because the unlawful presence was less then 180 days).
You will be fine.
Just be truthful that you filed 485 before; you had divorce and all the employers that you worked with. Only thing they can get you on is if you try to embelish or hide things even though they were forgiven when you left and re-entered.
UN from what I read he was out of status from Mar 2003 to Apr 2004. Pls correct me if I am wrong

I, unfortunately could not make it to DC, however, I would love to hear more about what was done in DC and the kind of responses IV got from the offices...... I am positive there are thousands of members who wanted to participate in the event and could not do so for unavoidable reasons - and if the participants could post their experiences, it will give us a better idea and make us feel that we are a part of the efforts too (many thanks to those who have already done so - it is inspiring).

What Sheriff did is absolutely inhumane and entire human society must be ashamed of his act.
IMHO, When a lady is 9 months pregnant, NO punishment to her is justifiable. Not in this world or the world after us, as simple as that. Any punishment must be postpartum, after full recovery.
I can't believe there are people in this forum defending his actions.--Are we forgetting that Sheriff was dealing/punishing two people here? What did the unborn do to deserve this treatment?
After reading this thread and the posts by people who supported the sheriff--I really have a bad taste in mouth. How low did we stoop as a human society that we can't understand the labor pains?
