Yes; he was out of status from March 2003. However; he had a valid I-94 card until February 2004. He didn't have a valid I-94 from February 2004 until april 2004.
once;he left and re-entered then the out of status time was finished. Since he didn't overstay his I-94 card by more then 180 days then he is not subject to the 3 year bar.
If his I-94 card expired in March 2003 then he would have had unlawful presence from that date forward and since it was more then one year then he would have been subject to 10 year bar.

I also had same FNU problem.
In my passport Surname was empty and Give Name was my First Name + Last Name (which was actually my surname). I didn't notice this really till I got my first H1b Visa stamp. On DS Forms you have to fill just like in passport.
So my first H1-B visa had
Surname : First Name + Last Name and
First Name : FNU
I had my name proper on my first I-94 card( since I filled it) so luckily I was able to take by First DL in my proper name. DMV initially gave me trouble but when i showed my other documents including Birth Certificate they gave me the DL (NJ) with proper names
To fix it next time when I went for vacation back to India I went to issued passport Office and they stamped be an observation in one of the inside pages which said the name should be read as
First Name : My First Name
Last name : My Last name
Then when I renewed my H1-B later I properly updated my DS forms and my name came fine in second H1-B stamp .
So far no problem till now. I am hoping to fix this issue permanently in my renewal passport which I need to take in 2010 and forget about this forever.

Does one need to be on an F1 (students) visa to get an assistantship?? Can one work only on university campus while doing their assistantship?? If not where is one eligible to work on assistantship & what type of jobs are available?? My wife is planning to do her CPA on an H4 visa, can she work on assistantship while pursuing it??�Please respond.
I am sorry...I do not have too much info abt the H4 visas...Actually I am not sure whether she can do an assistantship on H4 only because it is not a visa on which you can get paid any compensation for work...Isnt the institute where she is doing her CPA sponsoring her F1??

I see that the above discussion keeps on going on about EB-2 only. Doesn't anyone at IV care about EB-3 I also . I am sure there are a few EB-3 I people at IV who are suffering from retrogression , myself included.
I disagree with you. There are not FEW EB3 I people but MANY who are suffering! EB3 I is in 2001. Guys have been suffering for over 7 years. EB2 not more than 4 years (or max 5 years).
Who is retrogressed more? IV members, we need your stories. We are going to make an all out effort to pass this on to senators/media folks to realize the urgency of the situation.
Who's story we need?
Your story about how you are affected by retrogression/back log etc. It could be as simple as 'I have a BS in Mathematics and am stuck in back log for 2 years and cannot fulfil my dreams professionally' to 'I have a PhD in Nuclear Science and US needs me coz there are only a handful of us!' Anything and everything works.
We have literally recieved stories of stay at home moms (because of H4 they cannot work) to folks who have been interviewed by MIT! The whole spectrum helps.....please please send us your stories...we need all the weapons when we go face the senators on behalf of IV
Why we need your stories?
Media folks
Sometimes we get approached by journalists who need a story the very next day. They are looking for specific subjects for the story though.
An example is say the Investors Business Daily (a financial daily). A reporter might come to us and ask us if we have anyone from the Finance sector who is suffering due to retrogression and is willing to speak up about it. They might also add that we need only Eb1/Eb2 category folks.
When this happens, we are in a mad scramble to find folks who fit this criteria so that we do not lose this chance.
Another example might be of a Medical Journal looking for doctors stuck due to retrogression.
We are constantly getting requests like this but cannot capitalize on it because we do not have enough stories already available to fit the criteria.
So please send in your stories. It need not be earth shattering at all (most of us are mere mortals). You never know when a reporter is specifically looking for a story similar to yours and you might just tilt the balance in favor of skilled immigrants.
We promise we will not reveal your story to media if you do not want to.
Though there is no harm to reveal one's name in media as can be evidenced by the folks featured in the Roll Call article, Philly Inquirer and News Observer.
At the same time we understand that you might have reasons to remain out of media and we will fully respect that.
Lawmakers
Even during the recess, we were talking to the staff of a ton of senators. Most of the time the senators' staff are interested only if someone from 'their constituency' is also affected. We always say we have a ton of folks from each state, but nothing works like a real example.
For example, when we speak to say Senator Kennedy, it helps us to present the story of folks affected by retrogression and living in say Boston, MA. That way, the staff has some incentive to look into this and get hooked immediately.
When we initially started meeting senators, their staff would ask QGA 'Immigration Voice, who or what is that?'
Lately when we go to meet them, most of the staff have already visited our website multiple times, know about us because of phone calls and faxes by members and ofcourse the articles that have been published....on top of this when we provide stories of members from their constituency, 50% of our work is already achieved....the liason team and QGA take over from there.

Plainspeak...no one here knows everything abt immigration. so its ok that u lost this argument. we are here to share out experiences, enlighten each other, and work for easing EB backlogs. The fact that theres no one in entire IV that supports ur argument should put some sense into you abt this issue.

Jobs in America is for Americans. If at all it gets outsourced to your country then it is yours. But as long as that job is in my country, I will defend it and not let some Strive or Skill act take it away from me.
How did you assume that our IV members do not have the will to gather together and ask for what they desire?

Since your file is at TSC, there is an email address that AILA members have to request that your file be processed once PD is current. Contact your lawyer and ask him to check AILA InfoNet Doc. No. 08103067, that's where the procedure is outlined.
