I am eligible to file for 485 under the current (July) visa bulletin. My wife is transitioning from L1B(expired in May) to H4(Awaiting receipt) and is therefore out of status. I am wondering if she should apply with me (claiming that her status is H4) or should she wait till she gets her H4 (which could be in August).
My questions are:
1. Is it necessary that one's spouse should apply concurrently?
2. Can one's spouse (H4) apply for 485 as a follow up to her husband's application in July even if the visa numbers are not available (i.e in August when the visa bulletin says Unavailable)?
please help.

People are sending this not make anything to change here. As long as the point is conveyed and there is media coverage, there is some redemption
People are doing this to gain a visibility and acknowledgement of our suffering.
So please encourage this rather than put a negative remark like this.
If you do not want to send it, its fine. Nobody is forcing anybody.
The flowers are going there is large numbers irrespective of what IV says or anybody says
There is no point in sending flowers knowing nothing gonna change. it is like putting flowers to us.

Thank you all for contributing. pls. contribute generously. Till now a little over 100 have contributed out of 7650 members. In the past few days about 3000 members visited this site. you can do the math.
That is discouraging, guys..even if you are new to IV, and are still checking out, COME-ON cant you contribute $20. Your money is being used very efficiently. I am not a core member, but I trust these guys, they have been working hard putting in their own hard-earned money for travelling, and carrying out IV work. At this point, IV really needs two things, more members and more FUNDS . IV needs you to contribute, even if it is $20

filings today as the counting of H-1B petitions received on April 2 and 3 continues. On April 3, USCIS
announced that it had received enough petitions to meet the congressionally mandated cap for fiscal year
2008 (FY 2008) and that it would conduct a computer-generated random selection of cap-subject petitions
filed on Monday (April 2) and Tuesday (April 3) to determine which cases would be accepted for processing.
As of April 9, USCIS has determined that approximately 119,193 of the H-1B petitions received on April 2
and 3 are subject to the FY 2008 congressionally mandated cap.
USCIS received on April 2 and 3 a total of approximately 12,989 cases requesting an exemption from the FY
2008 H-1B cap because they were filed on behalf of aliens holding a master�s degree or higher from a U.S.
institution. USCIS can now announce that the cap of 20,000 on these exempt cases remains open and that
USCIS will continue to monitor these filings.

Following up on my previous post. Here is the format for the ad and the affidavit. We went to the DC embassy to get the name changed and they have next day (business days only) passport-by-mail service. I don't think they have same day service.
Actual correct name: <corr_first_name> <corr_last_name>
Current Name on passport: <first_name_pp>
Name in US docs (Visa, SSN, Drivers Lic.):
<first_name_us> FNU _OR_ <first_name_us> <first_name_us>
Format of the ad we placed in Indian newspaper (TOI) and local US newspaper:
I, <first_name_pp> AKA <first_name_us> FNU AKA <first_name_us> <first_name_us> d/o <dads_name> R/o <indian_address/us_address> have changed my name to <corr_first_name> <corr_last_name>.
Format of Affidavit from India (on Rs. 10 Non Judicial Stamp Paper):
AFFIDAVIT
I, <first_name_pp>, D/o <dads_name>, R/o <indian_address>, do hereby take oath and solemnly declare as under:-
1. That I have declared my name as <first_name_us> <first_name_us> earlier.
2. That I have declared my name as <first_name_us> FNU earlier.

We found out at the embassy that we could have used our India issued marriage certificate (which had my wifes correct name) and avoid doing all this. Placing the ad, getting the affidavit and posting it to US all took a total of 1 week. We went to the DC embassy early on a Friday and we got the passport with the name changed via mail by Monday.
Another friend of mine got the same thing done via the mail-in service. It took him 2 weeks to get the passport back.

Weird situation, I decided to call the 800# and got a nice lady who unfortunately spoke very fast for me to grasp.
I mentioned that Since my 140 approval in Jan '09 and as Primary applicant who received a 2nd fingerprinting notice (completed on 5th July 09) and my wife never received any notice.
When I mentioned that I have not received any case updates at all no LUD's even. She checked her systems and said I can see your case is transferred to VSC in Feb '09 and they are currently processing July 24, 2006 you case is within the time frame for processing. When I mentioned that my case has gone from NSV -->TSV -->VSC she could say no more except that they are within the processing time frame. She couldn't give any more details if the case is pre-adjudicated or not.
I mean what the point of PD if their are processing at their schedule and if every transfer means a new shift in dates. I got to get an infopass appointment since the dates are current for me next month.
Sucks just when i wanted to shift houses and now lawyers says wait since your dates are current do not risk doing AR-11

This is very nice, but lets not make it EB2 India specific, other EB2 and EB3 has the very same issues. Let make it a bit more generic so that everyone can participate. 100 letters would not achieve anything 1000 would surely make a difference.

Jobs in America is for Americans. If at all it gets outsourced to your country then it is yours. But as long as that job is in my country, I will defend it and not let some Strive or Skill act take it away from me.
its not as simple as a job. Many technology jobs are created in America because of companies founded by immigrants (google, Sun, eBay, Yahoo the list goes on). By not letting in these immigrants (who are motivated and capable of starting their own business) you make them start that business in China or india. You are LOSING american jobs.
